Based on the Indonesian law UU Num. 37 year of 1999 regarding Foreign Affairs, the Department of Foreign Affairs is the main gateway to the establishment of International Non-Governmental Organizations (NGOs) in Indonesia. International Non-Governmental Organizations intending to perform activities within the Indonesian territory must fulfill the criteria below: 1. The organization was founded in a country that has diplomatic ties with Indonesia; 2. The organization does and will not perform any political activities in Indonesia; 3. The organization does and will not perform any activities related to religious proselytization or dissemination in Indonesia; 4. The organization does and will not perform any commercial activities aimed at garnering profit; 5. The organization does and will not perform any fundraising activities in Indonesia.
UU Num. 37 year of 1999 regarding Foreign Affairs
In proposing a request, the International Non-Governmental Organization must attach the following documents: 1. A letter proposing the establishment of a Representative Office in Indonesia; 2. A letter describing the appointment of the Head of the Representative Office in Indonesia by the main Office or headquarters; 3. A recommendation letter from the Embassy of the home country of the organization in Indonesia; 4. A certificate of the organization’s establishment; 5. The organization’s budget plan and organizational structure; 6. The organization’s source of financials and organizational financial mechanism; 7. Plans and programs planned on being conducted in Indonesia; 8. Profile and information regarding the organization; 9. List of local affilates, if available
1. Submit a request letter to the Indonesian Government to the Department of Foreign Affairs thorugh the Directorate of Social Culture and International Organization for Developing Countries. Other related bodies or councils of other governments can provide recommendations if deemed necessary. 2. The Department of Foreign Affairs will proceed to conducting verifications on the credibility and completeness of administrative documents submitted by the International Non-Governmental Organization through the Representative of the Republic of Indonesia overseas. 3. The Department of Foreign Affairs holds inter-departmental meetings for applications considered to have fulfilled administrative prerequisites. Representatives of the applying inernational non-governmental organization present the visions, missions, work plan and objectives of their organization during this presentation session. 4. Members of the inter-departmental meetings decide whether the international organization is eligible for registration and is allowed to perform activities within the Indonesia. Admission and rejection is delivered to the international organization submitting the application. 5. Accepted International Non-Governmental Organization will be recommended to affilate with a state or governmental department or institution. The governmental department or institution appointed as an affiliate to the International Non-Governmental Organization and the organization should establish a Memorandum of Understanding (MoU) as an umbrella agreement. 6. The approved MoU is then signed and addressed to the State Secretariat. 7. With respect to extension of permits, the following steps should be taken: ? Before the expiration period of the MoU, the International Non-Government Organization is mandated to submit a request of extension to its governmental affiliate. ? The affiliate proceeds to holding an interdepartmental meeting to evaluate the request. The meeting discusses the approval or rejection of extension. ? If the meeting approves of the extension, a new MoU outlaying a new work plan must be created. If rejected, a written rejection will be directly delivered.
